Terms of Service

These Terms of Service ("Terms") govern your access to and use of PILOTMAST services ("Services") provided by Carlos Eduardo V. Baldez d/b/a PILOTMAST ("we," "us," "our"). By submitting the audit form, booking a call, or engaging us for paid services, you agree to these Terms.

1. Services we provide

PILOTMAST designs, configures, and operates automation systems for local businesses, including but not limited to: missed-call text-back automation, appointment recall sequences, lead-follow-up workflows, review-request automation, and CRM integration. Specific deliverables for each engagement will be defined in a written Statement of Work (SOW) or quote provided to you before payment.

2. Pricing & payment

Current pricing (Starter setup + /mo, Pro ,500 setup + /mo) is published on our website and subject to change with notice. Setup fees are billed upon engagement and are non-refundable except as set forth in our Refund Policy. Monthly fees are billed in advance and automatically renew until canceled.

3. No earnings guarantee

Any revenue, appointment volume, lead count, review count, or ROI figures shown on our website or marketing materials are illustrative benchmarks drawn from third-party industry sources (e.g., PatientPop, Weave, Service Titan, MIT Lead Response Management Study). They are NOT a guarantee of the results you will achieve. Your results depend on your existing customer base, current systems, market conditions, your follow-through on integration access, and many other factors outside our control. We make no warranty of revenue outcomes.

4. 30-day money-back guarantee

For new Starter and Pro engagements, we offer a 30-day money-back guarantee starting on the date your system goes live ("Go-Live Date"). To qualify for a full refund of setup and first-month fees, you must: (a) have provided all required integration access (calendar, current CRM, PMS, phone forwarding, etc.) within 5 business days of engagement; (b) have actively used the system for the full 30-day period; and (c) submit a written refund request to carlos@pilotmast.com within 30 days of Go-Live. Refunds will be issued within 14 business days of approval. Full terms in our Refund Policy.

5. Cancellation

You may cancel at any time with 7 days notice. There is no annual contract or cancellation penalty. Upon cancellation, we will export your contact data and pipeline records and deliver to you within 7 business days. You retain full ownership of your customer data at all times.

6. Your responsibilities

7. HIPAA & PHI

PILOTMAST is NOT a HIPAA-covered entity by default. For healthcare clients (dental, medical, etc.), we help configure your messaging tools to minimize Protected Health Information (PHI) in routine communications. A Business Associate Agreement (BAA) between you and your messaging vendor (GoHighLevel, Twilio) is your responsibility; we facilitate setup. For Pro-tier healthcare engagements, we can execute a separate BAA upon written request.

8. Intellectual property

You own your customer data, content, and brand assets. We retain ownership of our proprietary workflows, templates, and methodologies. Any deliverable specifically built for you is licensed to you for unlimited internal use; we retain a non-exclusive license to incorporate generic learnings into future work.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or our Services is limited to the total fees you have paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or revenue.

10. Governing law & venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Denton County, Texas. You waive any objection to such venue.

11. Changes

We may update these Terms with at least 30 days notice for existing clients. Continued use after the effective date constitutes acceptance.
